It is beginning to sound like election day will come and go, after-which, surprise!!! some elected officials' minds will change. Will it be, "our hands are tied," or "after careful re-consideration...."

As many as it takes to get BOTH sides of the issue. This is very important to both sides of the fence. Don't comment if you don't want to. I for one am glad to keep getting new info as it keeps changing.
Obviously I wanted to comment in which I did. It would be nice to see them in one or two threads instead of 15-20 and you have to search through all of them.

How many of you read last night Enterprise? 85 tons of partilite particals will be emitted into the air from the power plant should it be built here. People who suffer breathing problems, allergeries, etc, how will this effect them? I have a grandchild with asthma as well as a daughter. Why haven't this been brought to the public attention sooner? As I said before," what goes up must come down. "

I've been asking that question for months. It would seem that that's all they have to do. Why waste time and money on lawsuits?
But in reading news accounts of the the siting board decision, there appears to be some leeway in the ability of the company to go back to the siting board if they can not negotiate terms for the water sale.
The state Department of Environmental Protection has ruled in favor of the company behind a proposed power plant in its case before the city Conservation Commission.
The commission rejected the power plant last October. The company, Boston-based Advanced Power Services NA, appealed the decision to the DEP.
The DEP issued a superseding decision earlier this month, said Stephanie Danielson, chair of the Conservation Commission. If it stands, the decision would represent a crucial step for the project.
The State lies!The EFSB (State Board) said that Brockton would have its say about the Power Plant, but as we now see that is not true. The State uses Brockton as a DUMPING GROUND!
Now our state elected officials have to step in and pass the HOME RULE PETITION that the Mayor and the City Council sent to the State House for approval, this would stop all the lies! Call your state Rep & Senator and tell them enough is enough - stop it now!
John and Johnboy00...you hit the nail right on the head. While people keep saying the city has the power to stop it, the developers keep getting approvals. They also received approval from the planning board and now the environmental permits. I don't think the state lied at all. I think we all assumed that the city would have a legal basis to stop the plant...but no one can elaborate on what that is. It's a great campaign issue to talk about during election time...but no one ask the critical question...how will it be stopped?
P.S. The legislature already denied a similar petition last year. This new one is DOA.
The reason the Power Plant people are still here is money. The profit in the plant is very substantial, and don’t forget about the land sale. Ron Kelly of Brockton Power will not answer the question on how much they will pay for the land to the owner of the land and to the few close investors who are very outspoken and say Brockton NEEDS this Power Plant!
As for the State the same goes in my opinion – MONEY!
Brockton Power first submitted to the volunteer Conservation Board that the highly paid engineers for the 350 million dollar project, that the plans showed structures that violated the buffer zone of the river. But now the State want to bypass Brockton’s Conservation Board before a complete review can be done. Why what else is wrong?
This doesn’t pass the smell test – MONEY-MONEY-MONEY to the chosen few!
It also remains a mystery why the pp people have not publicly received any requests from other surrounding communities to "please, please," "build it here! build it here! if the pp is indeed such a beneficial thing for communities.
Another question remains too, why such determination to built it in densely populated Brockton?
That the people of Brockton have so clearly made it known, no thank you, WE DO NOT WANT A POWER PLANT BUILT IN OUR CITY is no mystery.
And yes, there very much appears to be a $trong rotten smell regarding why the pp people remain determined to try and ram this thing down the throats of we the people.

As I read it it is simply an order of operations issue. The conservation commission said you have to do these things first and the state rejected their argument. I'm not sure who is right on this but I would think that conservation rules would be a requirement of almost any large project and there must be lots and lots of precedence for what needs to be done.
If there are true buffer zone violations, first that would be stupid on the part of the company and second I don't think the state would override that.
I hate to burst everyone’s bubble, but the reason why this is going through is that the city cannot stop the plant.
Unfortunately the city officials will never admit this in an election year. The state board approved the plant on the condition that it receives several local approvals: zoning and planning approvals, conservation approvals, and approvals for the use of the city’s wastewater. Advanced Power/Brockton Clean Energy has already received the planning approvals and just got approved for their conservation permit. There’s usually no basis to deny developers these. They can only place certain restrictions on how they construct the structure. So they get these limitations imposed and the project still moves forward.
The next hurdle is to get variances from the zoning board and then approval to use wasterwater from the city. The city has the right to limit the height of certain towers on the plant. However, smaller towers don’t necessarily help reduce the exposure to the emissions. Actually, the higher the tower the better for city residents. So any restriction on the height, doesn’t stop the project, it just changes the design of the towers and structures.
The final hurdle is a vote from the city council to allow the developer to use wastewater to cool the towers. The state siting decision doesn’t prevent the developers from using other sources of water. In fact, Adavnced Power could connect to the city water tomorrow. State law gives any property owner the right to do that. The city council could reject their request to use wastewater, but they know they cannot reject their request to use water flowing down the city’s water main. So in the end, the plant will get the water they need.
All this explains why the city has been trying to use home rule petitions and lawsuits (appealing the state decision) to fight this thing. They realize that there is no legal basis to stop the development.
Willrocku, I hate to tell you, there is no way to stop it. JohnBoy00…no one will ever admit this BEFORE an election. I think you’re right, this will be one of those things that people pick up on AFTER the election. You would think after the city officials promising to stop this thing for 3 years, people would figure out that (outside of passing a resolve or authorizing $$ for legal challenges) nothing has worked to slow down this train that is pulling in. Maybe the media isn’t paying close attention, or the public isn’t thinking this through. I just don’t see how realistically this thing gets stopped.
I also say if (very little if) this power plant gets built, the city should sell them water from the desal plant and watch that meter spin, and tax the hell out of them (NO TIFFS). However I don't think they will, this was inked/done a long time ago, IMHO. The right hands were/are greased.
So glad I moved out when I did.

Good point dannymjr. Maybe the newspaper will read IB and ask some more questions or do a follow up article on this. I wonder how people would react if in fact they found out that this is true...especially after so many city officials said they could stop it.
For the record anything can be stopped. Anything. Just takes fortitude, luck and some legal grounds (which there are).

Even if we end up loosing we can still make the PP life a living hell while they are here. We dont have to be friendly neighbors if you will.we can complain about every damm thing they are doing and make sure they are closely watched and if they step out of line just one little bit be there to make it just a little harder for them.
City officials can't stop this mess This is a terrible punishment to this city by Yunits, lining his pockets. He gets paid by the power plant and by the Desal Plant. He is so damn far into conflict of interest (read crook),along with the Rox, it is amazing that DA, feds haven't gone after him.
The only thing city gov can do now is sell them waste water or Desal at highest rate possible. Either way, Yunits lines his pockets at the risk to your childrens' health.
